The legal profession has undergone profound transformation over the past two decades, driven by new technologies and forms of legal service delivery that are upending the traditional organisation of legal work. These changes are disrupting career pathways and requiring lawyers to rethink the skills that will be required for future success. The [Coronavirus Disease 2019] COVID-19 pandemic spurred further integration of new technologies, and challenged long-held norms in relation to how and where lawyers should work. Collectively, these changes are occurring against a backdrop of persistent gendered inequality. It should be noted that there have been substantial improvements in women's numerical representation in the legal profession. Under current Law Society of New South Wales leadership, a 20-year trend toward convergence in men's and women's participation in the Australian legal profession has been realised. For example, women now outnumber men in the legal profession in all states and territories across Australia, and in New South Wales, female solicitors have outnumbered male solicitors for a sixth consecutive year. While women remain under-represented in senior leadership roles including as partners, principals, barristers, and judicial members, over one third (35 per cent) of private practice partners/principals in New South Wales are now women. In corporate and government legal roles, there is now an even split between women and men in senior roles. Numerical dominance aside, issues of gendered discrimination, disrespect, and harassment remain stubbornly entrenched in the profession.

Retail work is undergoing profound transformation, with rapid changes including digitisation, the collection and use of big data, and automation reshaping the industry and the skills required to work within it. These transformations have the potential to entrench and even exacerbate existing inequalities within the industry. Based on interviews with 30 senior stakeholders in retail and retail-adjacent industries, and a representative retail, fast food and warehouse worker survey, this report examines perceptions and experiences of intersecting technological transformations occurring in the Australian retail industry and the changing skills sets required for the future of retail work.

This study addresses the dearth of gender analysis within debates about technological innovation and workplace change. Qualitative analysis of 12 focus groups conducted with women in 'frontline' and 'professional' roles discussing their use and engagement with digital technologies at work reveals contrasting narratives of 'digital frustration' and 'digital invigoration'. To explain these distinct narratives, we synthesise insights from science and technology studies with findings from scholarship on gendered work and labour market inequality to show that these differences are not driven solely by a technology's form or the degree of automation it ostensibly represents. Instead, women's narratives reflect an interplay between technological design, employment context and workers' own voice and agency. These findings challenge assumptions about the totalising and transformative power of work-related technologies, redirecting attention to how social and political contestations over digital technologies inform worker experiences and shape the future of work.
